1. Agreement to Terms

By accessing or using Magpie (“Service”), operated by SeaQuest.dev (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Magpie is an AI-powered email management platform that provides:

  • AI-generated email summaries
  • Automatic task and action item extraction
  • AI-assisted draft reply generation
  • Email organization and categorization
  • Integration with email providers (Microsoft 365, IMAP/SMTP)

3. User Accounts

To use the Service, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Plans: We offer three subscription tiers: Starter ($50/month), Professional ($100/month), and Ultimate ($200/month).

Free Trial: All plans include a 14-day free trial. No credit card is required to start a trial.

Billing: Subscriptions are billed monthly in advance. Payments are processed through Stripe, a PCI-compliant payment processor.

Cancellation: You may cancel your subscription at any time. Access continues until the end of your billing period. We do not provide prorated refunds for partial months.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Transmit malware, viruses, or other harmful code
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Use the Service to send spam or unsolicited communications

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

We use AI technology (Claude by Anthropic) to process your emails. Your email content is processed to provide the Service features but is not used to train AI models.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SeaQuest.dev and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your email content. You grant us a limited license to process your content solely to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that AI-generated content will be accurate, complete, or error-free. You are responsible for reviewing and verifying all AI-generated summaries, tasks, and draft replies before taking action.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAQUEST.DEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms.

Upon termination, your right to use the Service will cease immediately. You may export your data before termination. Data is retained for 30 days after termination before permanent deletion.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
